Read the Following Terms and Condition prior to Use of Any Service
IF YOU ARE A PATIENT WITH MEDICARE, YOU ARE NOT ALLOWED TO USE THIS SERVICE DUE TO AGREEMENTS BETWEEN THE LAB PROVIDER AND MEDICARE.
Freedom Lab Orders requires all customers agree to and adhere to the following Terms and Conditions of use. If you “the customer” do not agree to these Terms, you are NOT authorized to use our services. The ordered blood tests are for informational purposes only and Freedom Lab Orders is not required to notify any customer regarding their results or interpretation thereof.
You agree to, and will adhere to, “Direct Access State Regulations,” when using Freedom Lab Orders, lab order services, for a lab requisition, for you the customer. Some “states” meaning, “States of the United States,” may require you to reside in the state, or physically be in the state, which allows direct access, in order to self order, self choose, or self create, lab test orders. You agree to adhere to the state law when using Freedom Lab Orders to obtain a lab requisition. See Direct Access By State webpage found at freedomlabtests.com for a more thorough definition of Direct Access. We at Freedom Lab Orders hold you solely responsible to know the current state laws and regulations related to “Direct Access State Laws And Regulations,” and follow, and adhere to, the present state regulations and laws, in the state you reside, or are presently in, before you order lab tests with Freedom Lab Orders. You agree, you will not hold Freedom Lab Orders, Riverton Medical, or their owners, providers, employees, or other associated members, liable for any violation, by you, to adhere to the state code regulations or laws relating “Direct Access.”
All lab results will be accessed by customers through the MyQuest Portal or via Quest Diagnostics directly. Any questions, concerns, lab result data, including lab results within or outside of normal range, is not the responsibility of Freedom Lab Orders and you, meaning, the customer, client, or visitor to the site is to reach out to their personal medical professional for interpretation of the lab work and for guidance and/or diagnosis.
If the customer resides in the State of Utah, the customer may reach out to Riverton Medical for a Virtual Focused Primary Care Office Visit for any non urgent matters and if a lab review visit is desired.
The customer agrees blood tests ordered and purchased through Freedom Lab Orders do not include medical advice for any medical disease or medical condition. You also understand and agree that lab test results can be inaccurate through no fault of Freedom Lab Orders, and the customer understands the Services provided by Freedom Lab Orders are provided at your request and labs ordered are not suggested by any of our providers. As an online service we do not have a traditional doctor-patient relationship and do not provide CPT codes, ICD diagnosis codes, or other provider information to file insurance claims. ANY LABS ORDERED ARE NOT TO BE BILLED TO INSURANCE, BY FREEDOM LAB ORDERS OR BY YOU, AND YOU, THE CUSTOMER, ARE NOT ALLOWED TO REQUEST INSURANCE COVERAGE BEFORE OR AFTER PAYMENT TO ANY MEDICAL INSURANCE COMPANY OR HEALTH SHARE AGENCY. THE LAB PROVIDER ABSOLUTELY PROHIBITS IT BY LAW.
Limitation of Liability
You agree, Freedom Lab Orders, or any of its employees or owners not be liable to you or any third party for any damages, losses, or illegal conduct of other users of the services related to your lab order or any other purchase or services provided by others including third parties.
Freedom Lab Orders will NOT be liable to you or any third party for any lost data, costs, third party claims, service delay, or interruption of services.
If Freedom Lab Orders is found liable to you or to any third party as a result of any claims or other matters arising under or in connection with these terms and services, the maximum liability for all such claims, per calendar year, will not exceed $150.
Medical Emergencies
Freedom Lab Orders makes no guarantee of a set response time to any inquiry by any particular customer inquiry. As such, if you are experiencing a medical emergency, seek medical assistance or proceed to the ER.
Indemnification
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you. You agree to defend and indemnify Freedom Lab Order, and our providers, owners, employees, representatives and agents, against all claims, demands, suits or other proceedings and all resulting loss, damage, liability, cost and expense (including reasonable attorneys’ fees), made by you and any third party arising out of: (a) your access to and use of the services and other materials available on or through the Services; (b) content, data, or information that you submit; (c) your violation of these Terms; (d) your violation of any rights of any third party; and (e) any unauthorized use of a username, password, or account number.
Disclaimer
The services provided by Freedom Lab Orders is at your own risk. We provide no warranty to lab result failures by third party labs such as Quest Diagnostics, the interpretation, or information provided by Quest Diagnostics or any other contracted third party lab of our choice.
Waiver of Jury Trial
You knowingly and voluntarily waive the right to jury by trial in any action arising relating to the terms and conditions.
Other Terms and Conditions
You agree to allow Freedom Lab Orders to use the personal information you provide, including your name, phone numbers, addresses, and electronic contact information, including email communication, and allow Freedom Lab Orders or any of its employees, or other members, to transmit lab orders, lab results, and any other information deemed necessary to you through any of these communication channels. You also agree to not hold Freedom Lab Orders liable for such transmissions of your personal information. You also agree to not hold Freedom Lab Orders liable for any error in transmission of any of your personal information including lab orders, results and any other information deemed necessary by Freedom Lab Orders, to you, through any of the information channels which you provide to Freedom Lab Orders when ordering lab work, or amending your contact information, verbally or in writing, or when obtaining results or requesting results.
Any concern, complaint, or claim must be electronically sent to Freedom Lab Orders prior to getting lab work completed.
Please print a copy of the terms and services immediately after or prior to acceptance of this contract, and in all cases prior to obtaining lab work. Please print a copy of your lab order as soon as it is received by you. All lab orders will be sent to the email address you provide us at checkout or as provided by you as identified in your customer account.
Possible evidence of use by you of the Services, for illegal purposes, will be provided to law enforcement authorities.
The Terms do not confer any rights or benefits upon any third party or person other than you.
If any provision of these Terms is deemed invalid or unenforceable, that provision will be stricken and will not affect the validity and enforceability of any remaining provisions.
You understand that Freedom Lab Order provides an administrative service, not a medical service. As such, you understand Freedom Lab Orders does not accept insurance or file insurance claims.
BY ACCESSING AND USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THESE TERMS OF USE.
